10.3 — Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i) and Thai Copyright Act B.E. 2537, we will terminate accounts of users who are repeat copyright infringers. Users who receive three (3) valid DMCA complaints will have their accounts permanently suspended.

IMPORTANT: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SPAMANAGER, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid to SpaManager in the twelve (12) months preceding the event giving rise to the claim, subject to the provisions of our Terms of Service (Section 15).

14. Governing Law & Jurisdiction

This Disclaimer shall be governed by and construed in accordance with:

  • The laws of the Kingdom of Thailand, without regard to conflict of law principles.
  • Specifically: the Thai Civil and Commercial Code, the Computer Crime Act B.E. 2550 (as amended), the Electronic Transactions Act B.E. 2544, and the Personal Data Protection Act B.E. 2562 (PDPA).

Any disputes arising from or relating to this Disclaimer shall be resolved through binding arbitration administered by the Thailand Arbitration Center (THAC) in Bangkok, Thailand, conducted in the English language. The arbitrator's decision shall be final and binding.

If any provision of this Disclaimer is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Changes to This Disclaimer

We reserve the right to modify this Disclaimer at any time. Changes will be effective immediately upon posting the updated version on this page with a revised "Last Updated" date. Your continued use of the website or Service after any changes constitutes your acceptance of the modified Disclaimer.
